Wright State University Social Media Terms of Use
These terms of use (the “TOU”) apply to all official and affiliated social media pages listed in Wright State University’s (“Wright State’s” or the “University’s”) Social Media Directory (wright.edu/social) (the “Directory”).
1. Definitions.
- Affiliated Page: A page on a Social Media Platform created by a University Unit to reach online communities in a professional or official capacity for communications and/or marketing. All content posted by a University Unit to an Affiliated Page must comply with University Policy. All Affiliated Pages and the content and digital properties posted to the same are owned by Wright State.
- A comment: Any information, communications, links, messages, images, photos, videos, or other data posted to a Social Media Page.
- Non-Affiliated Page: Any social media page which is neither an Official Page nor an Affiliated Page.
- Official Page: A page on a Social Media Platform sanctioned and controlled by Wright State by and through its Office of University Communications and Marketing.
- A privacy policy: A statement made by an organization regarding why, how, and pursuant to what legal authority (if applicable) personal data is being collected on a public webpage or social media page, and how the owner of the page will use any information obtained.
- Social Media Page: Either an Affiliated Page or an Official Page.
- Social Media Platform: A third party-provided platform on which a Social Media Page may be accessed and use for publishing, communication, engagement, and collaboration among individuals and entities.
- Terms of Service (“TOS”): A contract between a social media platform and a social media page account owner regarding such owner’s use of that social media platform.
- University Unit: Any office, department, division, organization, or other academic or administrative unit of Wright State, including, but not limited to, athletic and club sports teams.
2. Acceptance of Terms of Use.
Wright State provides Social Media Pages as an information service to you (a “User” or “Party”), subject to the following TOU and your acceptance of the same. If you do not accept any term contained in this TOU, you may not use any Social Media Page. Your use of any Social Media Page, either by visiting it or posting any Comments to it, constitutes your acceptance of the TOU contained in this document. By using any Social Media Page, you acknowledge and agree that such use is voluntary.
The following TOU may be updated by Wright State’s Office of University Communications and Marketing from time to time without notice to you. It is your responsibility to check these TOU periodically for any changes. Your continued use of any Social Media Page following the posting of any changes to these TOU constitutes your acceptance of such changes.
Please note that users of Social Media Pages are also subject to the TOS of each respective Social Media Platform (e.g., Facebook, Twitter, Instagram, Weibo, etc.).
3. Platform Privacy Policies.
By using or otherwise accessing Social Media Platforms, you are accepting the practices described in each Social Media Platform’s privacy policy and TOS. Wright State neither controls nor holds any responsibility over the privacy practices or TOS of the Social Media Platforms and, as such, all privacy laws and policies applicable to or stated by Wright State do not apply to such platforms.
When you visit a Social Media Platform, you provide it with two types of information: (1) personal information you may knowingly choose to disclose that is collected by such platform; and (2) information collected by such platform regarding your use of it. Wright State does not store any of this information or any additional user information beyond that which may already be stored for your account by the platform.
When posting a comment to a Social Media Page, you do so at your own risk. Although platforms may allow you to set privacy options that limit access to your account(s), please be aware that no platform security measures are perfect or impenetrable, and Wright State cannot control the actions of any other users who may be able to view your accounts and information. Wright State therefore cannot and does not guarantee that a comment you post to will be inaccessible to unauthorized persons.
4. Account Security.
You are responsible for maintaining the confidentiality of the login credentials of any account you use to access Social Media Pages. Wright State will not be liable for any loss or damage arising from any activities that occur under your login and/or account. See each Social Media Platform’s TOS for information regarding its own security practices.
5. User Conduct.
You understand that a comment, whether publicly posted or privately transmitted, is your sole responsibility. This means that you, and not Wright State, are entirely responsible for any comments you post, email, transmit or otherwise make available on or to a Social Media Platform. Wright State does not control any comment posted on its Social Media Pages, except as described below and does not guarantee the accuracy, integrity, or quality of any such comment. You also understand that by visiting Social Media Pages, you may be exposed to comments which are offensive, indecent, or objectionable.
You shall not use any Social Media Page to:
- Post, email, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, discriminatory, hateful, or racially, ethnically or otherwise objectionable;
- Harm minors in any way;
- Impersonate any person or entity;
- Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through a Social Media Page;
- Post, email, transmit, or otherwise make available any Content that you do not have a right to make available under any law or contractual or fiduciary relationships (such as, for example, classified information, inside information, proprietary, and confidential information learned or disclosed as part of employment relationships), or under nondisclosure agreements;
- Post, email, transmit, or otherwise use any depiction or reproduction of the Department seal or of any Department logos, symbols, or insignia without authorization;
- Post, email, transmit, or otherwise make available any Content that infringes any copyright, trademark, patent, trade secret, right of publicity, right of privacy, or other right of any party;
- Post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
- Post spam, automated messages, or other comments not related to the topic discussed;
- Post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
- Disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users’ ability to engage in discussions;
- Interfere with or disrupt a Social Media Page, the platform on which it operates, or servers or networks connected to Our Pages, or disobey any requirements, procedures, policies or regulations of networks connected to a Social Media Page;
- Intentionally or unintentionally violate any applicable local, state, national, or international law;
- Stalk or otherwise harass another user or person; or
- Collect or store personal data about other users.
By using the Social Media Pages, you agree that Wright State shall not be liable in any way for any comment you or any other person makes on the same. You also agree that Wright State shall not be liable for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via a Social Media Page or Social Media Platform.
6. User Acknowledgments.
By using the Social Media Pages, you acknowledge and agree that you understand the following:
- Wright State does not pre-screen all comments posted on the Social Media Pages.
- Wright State may in its sole discretion refuse, decline, block, edit, delete, or move any comment or content that is available on the Social Media Pages.
- Wright State may remove any comments or content that violates this TOU or is otherwise at odds with the intended purpose(s) of a Social Media Page, pursuant to its own policies.
- You agree that you must evaluate, and bear all risks associated with, the use of any comment you post, including any reliance by any party or other user on the accuracy, completeness, or usefulness of such comment.
- Wright State may preserve any comment or content on its Social Media Pages, or disclose the same, at its discretion for any purpose.
- Technical processing and transmissions with respect to a Social Media Page, including with respect to any comment you post, may involve (a) transmissions over various networks, and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
- Any comment or content that contains statements or depictions of violence against a person, group of people, or country, may be reported by Wright State to appropriate law enforcement agencies.
- Wright State may track and address violations of its policies and these TOU on Social Media Page to include carrying out potential blocking and other moderation actions.
- Wright State may block or remove posting functions from its Social Media Pages at any time.
- By posting a comment or content, you are granting Wright State a worldwide, non-exclusive, royalty-free, perpetual license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, perform, display and distribute such comment or content in any and all media or distribution methods now known or later developed.
- Wright State may in its sole discretion establish general practices and limits concerning use of Social Media Pages, including, without limitation, the maximum number of days that comments and content will be retained by each such page, and the maximum number of times (and the maximum duration of each) you may access a Social Media Page in a given period of time.
- Wright State may terminate your access to a Social Media Page, pursuant to these TOU and its policies, without prior notice and may immediately suspend your access to the Social Media Page.
- Wright State may remove comments or content posted to a Social Media Page in non-local languages.
7. User Duties and Obligations.
By using the Social Media Pages, you agree to the following duties and obligations:
- Legal Compliance. You shall comply with all federal, state, and local laws and regulations regarding online conduct and content, including all Wright State policies, as if you were a member of its staff or student population. You shall also comply with any applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside or from which you are using a Social Media Page.
- Indemnification. You shall indemnify and hold Wright State and its affiliates, officers, agents, grantees, or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of any comment or content you submit, post, transmit or make available through a Social Media Page, your use of the Social Media Platform on which it operates, your connection to such platform, or any violation by you of these TOU or of any rights of another.
- Duplication. You shall not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes or activities, any portion of, use of, or access to, a Social Media Page.
- Updates. You acknowledge and agree that these TOU may be amended from time to time and shall regularly check the same for changes and updates.
8. Wright State Disclaimers and Reservations.
- Wright State has no responsibility or liability for the deletion of or failure to store any comment or content maintained or transmitted by a Social Media Page and reserves the right to change any practices and limits regarding comments and content at any time, in its sole discretion.
- Wright State reserves the right at any time to modify or discontinue, temporarily or permanently, in full or in part, a Social Media Page that it operates and the functions available to users on a Social Media Page.
- Wright State reserves the right to delete or remove any comments or content Wright State has posted or provided on a Social Media Page and will not be liable to you or to any third party for any such modification, suspension, or discontinuance.
- Wright State reserves the right to change these TOU at any time and any changes will be publicly incorporated into these TOU.
9. Termination of Access.
Wright State may terminate your access to a Social Media Page in a manner consistent with these TOU or its policies if it believes that you have violated or acted inconsistently with the letter or spirit of the same. Wright State shall not terminate your access solely on the basis of your viewpoint. Wright State shall not be liable to you or to any third party for any termination of your access to a Social Media Page, so long as such termination is conducted in accordance with these TOU, its policies, or applicable law.
10. Links.
Links to social media platforms, websites, or digital resources may appear on a Social Media Page. You acknowledge and agree that Wright State is not responsible for the availability of any such external sites or resources, and neither endorses nor is responsible or liable for any comments, content, advertising, products, or other materials on or available from any such sites or resources. Any such third-party sites operate under separate Terms of Use and Privacy statements. Wright State shall not be liable for any breaches of information provided on any such sites.
You further acknowledge and agree that Wright State shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any comments, content, goods, or services available on or through any such site or resource.
