Negotiations: Article 21, Distance Learning

Both AAUP-WSU and the administration wish to change Article 21, Distance Learning. The parties exchanged their proposals on February 1; see the table immediately below. Current language proposed for deletion is shown in the strikethrough format, and proposed new language is shown in the red underlined format. For comparison, you may wish to view the entire current CBA and this article in particular.

There, you will find rosters of our Bargaining Council and Negotiating Team, a table showing the status of each article (those in the current CBA and new ones, too), and also reports about each negotiating session.

Thus far, no negotiations have taken place about the proposals below.

AAUP-WSU Proposal for Article 21, Distance Learning Administration Proposal for Article 21, Distance Learning

21.1 The term "distance learning" as used herein refers to a planned teaching/learning experience that makes significant use of any of a wide spectrum of instructional technologies to reach students who are separated by physical distance from the teacher. Such technologies may include live or recorded presentations and material using direct signal or cable, transmission by telephone line, fiber optic line, digital and/or analog video tape, audio-tape, CD-ROM, computer or internet technology, e-mail or other electronic means now known or hereafter developed.

21.2 The decision to develop a distance learning course or courseware for an existing course to be taught as distance learning shall be made by the Dean of a College following consultation with the college's technology committee and the Center for Teaching and Learning.

21.2.1 Any course so developed shall be subject to Department, College, and University procedures for review and approval of curriculum changes.

21.2.2 Any courseware so developed shall be subject to oversight by appropriate faculty committee(s) to ensure course quality and program relevance.

21.3 A distance learning course that is taught using materials developed by a Bargaining Unit Faculty Member shall be taught by that Member unless he or she has agreed in writing to an alternative arrangement.

21.5 Maximum and minimum class size for eacha section of each distance learning course will must be negotiated by the Bargaining Unit Faculty Member and the Department Chair. An agreement must be signed by them, and it must specify the complete teaching assignment for the Member for the term in question, together with the agreed-upon maximum and minimum class size for each section of each distance learning course. 21.5 Maximum and minimum class size for a distance learning course will be negotiated by the Bargaining Unit Faculty Member and the Department Chair.

21.6 Office Hours. In order to accommodate distance education student needs, if it is deemed appropriate by a Bargaining Unit Faculty Member who is teaching a distance learning course, some of the normally expected office hours may be held online to conduct business and consult with students. If all courses taught during a given quarter are distance learning courses, then all of the normally expected office hours may be held online.

21.7 Because Bargaining Unit Faculty Members may specify in their syllabi policies for students who do not “attend” a distance learning course (e.g., they do not access the course, or do not submit work, or otherwise do not participate in the course) just as they may do for other courses the University will regularly update the student database for a distance learning courses so faculty know who is enrolled and who is participating in the work of the course.

21.8 Faculty Rights and Responsibilities. Faculty rights and responsibilities pertaining to teaching specified in Article 7 apply to a distance learning courses as well as to other courses. In particular, section 7.6 “Classroom Atmosphere” applies as follows: Bargaining Unit Faculty Members may establish policies for students who exhibit rude online behavior in e-mails or discussions or both, may determine and administer appropriate consequences for such behavior, and specifically may remove and/or dis-enroll such students.

21.9 Compensation

21.9.1. For developing approved an online distance learning course approved in accordance with section 21.2, at a minimum, a Bargaining Unit Faculty Member will have the option to receive (1) release time equal to at least one one standard course within the college, or (2) salary equal to at least a customary course overload contract for one standard course in that Member's college (but no less than $500 per credit hour), or (3) some combination of (1) and (2). If the Member chooses to receive release time, the course reduction can be taken prior to the teaching of the distance learning course, or when the distance learning course is taught, or both. If the Member chooses to receive additional compensation, then such compensation will be paid to the Member within 45 days after finishing the development of the course. The particulars of (1), (2), or (3) must be negotiated by the Member and the University, and the agreement specified in a document signed by both parties before the development work begins. Intellectual property rights regarding materials developed for a distance learning course are specified in section 20.2.5.

21.9.2. For developing a video-based or Interactive Video Distance Learning (IVDL) distance learning course, a Bargaining Unit Faculty Member will receive no compensation unless the Dean approves an offer of compensation.

21.9.3 For teaching an online distance learning course the first time, at a minimum, a Bargaining Unit Faculty Member will have the option to receive (1) release time equal to at least one standard course within the college, or (2) salary equal to at least a customary course overload contract for one standard course in that Member's college (but no less than $500 per credit hour), or (3) some combination of (1) and (2). The particulars of (1), (2), or (3) must be negotiated by the Member and the University, and the agreement specified in a document signed by both parties before the teaching begins.

For teaching an online distance learning course after the first time, the Member can negotiate for continuing compensation, release time, or support for teaching the same distance learning course with the Department Chair or supervisor. The parties must both sign an agreement before the teaching begins specifying whatever compensation, release time, and support (if any) will be provided.

If the Member receives release time for teaching an online distance learning course (whether for the first time or subsequently), the course reduction can be taken during the teaching of the distance learning course, or in a subsequent term, or both. Likewise, if the Member receives additional compensation, then such compensation will be paid to the Member in approximately equal installments during the term in which the teaching occurs. a Member will receive salary equal to a customary course overload contract in that Member's college, but no less than $400 per credit hour. A Member who judges that the teaching of an online distance learning course will require extraordinary effort can negotiate for additional release time, compensation or support from the Department Chair or supervisor. In subsequent quarters, the Member can negotiate for continuing compensation, release time, or support for teaching the same distance learning course with the Department Chair or supervisor. All compensation for developing and teaching a distance learning course shall be determined and agreed to in writing before the Member develops or teaches such a course.

21.9.4. For teaching a video-based or IVDL distance learning course, a Bargaining Unit Faculty Member will receive no compensation unless the Dean approves an offer of compensation.

21.6 Pursuant to Section 20.2.5, Members who develop distance learning courseware involving significant University resources will enter into a written agreement with the University regarding the rights and responsibilities of both parties.

21.7 All compensation for developing and/or teaching a distance learning course shall be determined and agreed to in writing before the Member develops or teaches a course pursuant to Section 21.2. The University is not obligated to provide additional compensation for Members who develop or teach courses that utilize distance learning technologies if they have not been requested to do so by their Dean pursuant to Section 21.2.

21.9.5 Information for Students

Each section to be taught in an online or distance learning format will be clearly labeled as such in Wings Express so that any student contemplating registering for such a section will be aware of the online or distance learning status of the section.

The University will send a communication to all students who register for such a section that they have registered for an online or distance learning section; this communication will be sent within two working days after the registration occurs, and it will include a statement that students may contact the academic Department office for information regarding how to access course materials.
